By accessing or using marketplacejamaica.com and our services (the "Services"), including our website, applications, tools, and listings, you agree to comply with and be bound by this User Agreement and all associated policies, including our Privacy Policy and Trust & Safety Policy.
Important: Users are responsible for reviewing updates. Continued use of the Services after changes constitutes acceptance. Notice of updates may also be sent via email to registered accounts.

1. Acceptance of Terms
You must read and accept all terms and conditions of this Agreement to use Marketplace Jamaica. By registering, browsing, posting listings, or making transactions, you expressly agree to be bound by this Agreement. If you do not agree, do not use our Services. You must be at least 18 years old or have parental/guardian consent to use the Services.2. Changes to Terms
Marketplace Jamaica reserves the right to modify, update, or replace any part of this Agreement or related policies at any time. Changes are effective upon posting on the site.Important: Users are responsible for reviewing updates. Continued use of the Services after changes constitutes acceptance. 3. Registration and Account Responsibilities
To register, you must provide accurate and current information including your name, address, email, and phone number.You represent and warrant that:
- If you are a business, you are duly organized and validly existing under applicable laws and have authority to enter this Agreement.
- All information provided is accurate, complete, and up-to-date.
- You are responsible for maintaining the confidentiality of your account and password, and for all activity under your account.
Account Security
You agree to notify Marketplace Jamaica immediately of any unauthorized use of your account or security breach. Marketplace Jamaica is not liable for any losses resulting from unauthorized access if you fail to secure your account.4. Username and URL Changes
Users may change their username or URL once prior to completing a transaction. Changes cannot interfere with listings or transactions. For more details, visit the FAQ.5. Limitation of Liability
Marketplace Jamaica provides the Services "AS IS" and "AS AVAILABLE." We strive to keep Services secure and operational but do not guarantee continuous access or error-free operation. Marketplace Jamaica is not liable for any damages, including direct, indirect, incidental, punitive, or consequential losses resulting from:- Your use or inability to use the Services
- Delays, interruptions, or errors in the Services
- Viruses or malicious software obtained via the Services
- Content, actions, or inactions of third parties, including items listed
- Account suspension, termination, or modifications to listings
- Changes to this Agreement or Marketplace Jamaica policies
- Loss of profits, goodwill, or reputation
6. Users Policy / Prohibited Conduct
When using Marketplace Jamaica, you agree NOT to:- Fail to deliver items sold or fulfill obligations to buyers
- Interfere with other users' listings
- Post false, misleading, defamatory, or libelous content
- Infringe any third-party intellectual property rights or post counterfeit, stolen, or illegal items
- Undermine feedback or ratings systems
- Distribute spam, unsolicited messages, chain letters, or pyramid schemes
- Distribute viruses or harmful technologies
- Use robots, scrapers, or automated tools without permission
- Bypass security measures or impose disproportionate loads on our infrastructure
- Harvest or collect information about users without consent
- Circumvent any technical safeguards used by Marketplace Jamaica
Prohibited Transactions
You may not list or sell items that are illegal, adult content, weapons, drugs, or counterfeit. Marketplace Jamaica reserves the right to remove such content immediately.7. Enforcement and Account Actions
Marketplace Jamaica may, at our discretion, limit, suspend, or terminate accounts, remove content, reduce discounts, or block access for violations of this Agreement or policies. Decisions regarding listings, content, or accounts are final and may be exercised without notice, except where otherwise required by law.8. Indemnity
You agree to indemnify and hold Marketplace Jamaica harmless from any claims, demands, or legal fees arising from:- Your breach of this Agreement
- Improper use of Services
- Violation of any law or third-party rights
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Jamaica. Users agree that any disputes will be resolved under Jamaican jurisdiction. Optional: disputes may be resolved through arbitration where permitted.10. Reporting Violations
If you suspect abuse, violations, or fraud, please contact our team via Trust & Safety or Contact Us. Marketplace Jamaica may take technical or legal steps to prevent abuse.11. Entire Agreement
This Agreement, along with all policies and guidelines, constitutes the entire agreement between you and Marketplace Jamaica, superseding prior agreements.
